PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK & PUBLICITY RELEASE

PLEASE READ CAREFULLY. THIS IS A LEGALLY BINDING AGREEMENT.

By registering for and/or participating in The Ponte Vedra 10-Miler presented by Alter Ego Running (the “Event”), whether conducted in-person or virtually, and by signing or electronically accepting this agreement, I acknowledge and agree as follows:

I ACKNOWLEDGE THAT PARTICIPATION IN A ROAD RACE OR RUNNING EVENT IS A POTENTIALLY HAZARDOUS ACTIVITY THAT MAY RESULT IN SERIOUS INJURY, ILLNESS, PERMANENT DISABILITY, OR DEATH.

I understand that risks include, but are not limited to, falls; contact with other participants or spectators; traffic and roadway hazards; uneven surfaces; barricades and equipment; weather conditions including heat, humidity, rain, lightning, or extreme temperatures; acts or omissions of other participants, volunteers, spectators, or third parties; inadequate or delayed emergency response; illness, dehydration, cardiac events, communicable diseases, infections, and other medical complications. For virtual participants, I acknowledge that I am solely responsible for selecting a safe route, environment, and conditions in which to complete the Event.

I VOLUNTARILY AND KNOWINGLY ASSUME ALL RISKS ASSOCIATED WITH MY PARTICIPATION, WHETHER CAUSED BY THE NEGLIGENCE OR EVEN THE GROSS NEGLIGENCE OF THE ORGANIZER, HOST, OR OTHERS, OR OTHERWISE, TO THE FULLEST EXTENT PERMITTED BY LAW.

In consideration of being permitted to participate in the Event, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Izzo Brothers, LLC d/b/a Alter Ego Running; PRS Race Timing, LLC; RunSignup.com; Event Directors; sponsors; vendors; volunteers; contractors; timing companies; local municipalities; permitting agencies; property owners; law enforcement; emergency responders; and each of their respective owners, members, managers, officers, directors, employees, agents, representatives, successors, and assigns (collectively, the “Releasees”) from any and all claims, demands, causes of action, damages, liabilities, losses, costs, or expenses (including attorneys’ fees) arising out of or related to my participation in or attendance at the Event, my presence on Event premises or course, any injury, illness, death, or property damage, the adoption or enforcement of Event rules, or the cancellation, postponement, or modification of the Event, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE OR GROSS NEGLIGENCE OF ANY RELEASEE.

I agree to indemnify, defend, and hold harmless the Releasees from and against any and all claims, liabilities, damages, or expenses (including attorneys’ fees) arising out of my participation in the Event or my breach of this Agreement.

I certify that I am physically fit and sufficiently trained to participate in this Event, that I have not been advised otherwise by a licensed medical professional, and that I understand I should not participate unless medically able and properly trained. I authorize the Event Director or representatives to secure medical care deemed necessary in the event of illness, injury, or emergency, and I understand that I am solely responsible for all medical costs, transportation, and related expenses.

I understand that participation in the Event may expose me to viruses, bacteria, or communicable diseases, including but not limited to COVID-19. I knowingly assume all risks of exposure, infection, illness, or death related to communicable diseases arising out of my participation or attendance, including those resulting from the negligence of the Releasees.

I agree to abide by all Event rules and decisions of race officials, who may deny or suspend participation for safety or rule violations. I understand and agree that entry fees are non-refundable and non-transferable, and that the Event may be canceled, postponed, or modified due to weather, emergency, government order, or circumstances beyond the Organizer’s control, without refund.

I hereby grant to Izzo Brothers, LLC d/b/a Alter Ego Running and its affiliates, sponsors, licensees, and partners an irrevocable, perpetual, worldwide, royalty-free license to photograph, record, film, or otherwise capture my name, likeness, voice, image, race results, and participation, and to reproduce, edit, modify, distribute, display, publish, sell, license, create derivative works from, and otherwise use such materials in any media or format now known or hereafter developed, for any lawful purpose, including advertising, marketing, promotion, commercial sale, broadcast, print, digital, and social media, without additional consent or compensation. I waive any right to inspect or approve such uses and release all claims relating to rights of publicity, privacy, or defamation.

This Agreement is intended to be as broad and inclusive as permitted under Florida law. If any provision is found unenforceable, the remaining provisions shall remain in full force and effect. This Agreement shall be governed by the laws of the State of Florida, and any claim arising out of this Agreement shall be brought exclusively in the state or federal courts located in St. Johns County, Florida, to which I consent.

This Agreement is binding upon me and my spouse, heirs, executors, administrators, legal representatives, and assigns.

BY SIGNING OR ELECTRONICALLY ACCEPTING THIS AGREEMENT, I ACKNOWLEDGE THAT I HAVE READ THIS ENTIRE AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
