RELEASE OF LIABILITY, ASSUMPTION OF RISK, WAIVER OF CLAIMS & INDEMNIFICATION AGREEMENT

*NOTICE – By signing this document, you may be waiving certain legal rights, including the right to sue.

In consideration of being permitted to participate in the 2025 RAVE Green Run, together with any other promotional activities, (“Events”) taking place in and around the City of Renton on private and public land and rights of way (the “Course”) on or about September 7, 2025 (“Race Day”), the undersigned Participant (hereinafter “Participant”) and on behalf of themselves, their personal representatives, assigns, heirs and next of kin, and Participant’s parent(s) or legal guardian(s) if the Participant is under the age of 18 years old as of the Race Day, do hereby agree, to the fullest extent permitted by law, as follows:

1) TO WAIVE, RELEASE, DISCHARGE AND HOLD HARMLESS Seattle Soccer LLC d/b/a Seattle Sounders FC, Major League Soccer LLC (“MLS”), Soccer United Marketing LLC (“SUM”), United Soccer Leagues LLC (“USL”), UNICO Properties, the City of Renton, sponsors, volunteers, Fizz Events, the RAVE Foundation, and Providence Swedish and each of them, their owners, officers, directors, managers, agents, affiliates, sponsors, franchisors and employees (“Releasees”), from and against any and all damages, costs, losses, expenses, claims, lawsuits, actions, and liability for any and all damage, foreseen or unforeseen, demand or injury to the person or property of the Participant, including death, whether caused by the negligence or carelessness of the Releasees whether active or passive, the actions of other participants and third parties, hidden, latent or obvious defects in the Course, fixtures or equipment used, or otherwise, whether past, present, or future, arising out of or in connection with Participant attending, working, volunteering, observing or participating in the Events, or any other purpose related thereto without regard to negligence or carelessness by any of the Releasees (“Released Claims”).  The Participant understands, acknowledges, and accepts that Participant or their successors may not now fully know the number or magnitude of all of the Released Claims, but nevertheless intends to assume the risk by releasing such unknown claims and agreeing that this Waiver and Release is a full and final release and waiver of all Released Claims.  Participant expressly agrees that this Waiver and Release is intended to be construed as broad and inclusive as is permitted under the laws of the State of Washington and that if any portion thereof is found invalid, the remainder will continue in full legal force and effect. Participant further agrees that any legal proceedings related to this agreement shall take place in Seattle, King County, Washington.

            2)  TO ASSUME ALL RISKS of participating in the Events, including without limitation the risk of contracting COVID-SARS2 aka Covid-19 or any other communicable disease or illness (including exposure to bacteria, virus, or other pathogen capable of causing a communicable disease or illness), accidents, property loss or damage, bodily injury, disability, or death regardless of the care and precautions taken by the Releasees, and may include contact or collision with persons or objects, inadequate or negligent first aid and/or emergency measures, weather-related hazards, natural hazards, and certain other risks not known to Participant which are not reasonably foreseeable at this time, and that Participant is voluntarily participating in the Activities with full knowledge of the risks involved and ASSUMES FULL RESPONSIBILITY FOR ALL RISKS.  Participant expressly acknowledges and agrees that the Events may involve physical activities and that running on the Course may involve running on different and uneven surfaces including asphalt/concrete, grass, streets, sidewalks, gravel and in areas that may not be maintained specifically for the purpose of running activities like the Event.  Participant fully acknowledges and further agrees that the Events are physically demanding, involve other participants of varying fitness levels and experience, contact with other runners, all portions of the Course are outdoors and subject to the weather and conditions on Race Day, and to the best of Participant’s knowledge, Participant is able to participate fully in the Events.  Participant expressly accepts all known and unknown risks, including but not limited to, tripping and falling, slipping, contacting or impacting other racers or fixtures or items on the Course, adverse weather conditions, animals, vehicular traffic, extreme heat or cold related illnesses, dehydration, COVID-SARS2 aka Covid-19, exhaustion, the negligence or carelessness of other participants, volunteers, or the Releasees, criminal activities, and injuries including those due to use or overuse of the body or body parts.  Participant and Participant’s parent(s) or legal guardian(s) understand that there are inherent risks of participating in the Event, which may be both foreseen and unforeseen and include serious physical injury and death.

             3) TO AUTHORIZE Race Day organizers and/or of their respective agents or assignees to provide basic first aid treatment of minor injuries and to direct other medical treatment including authorizing emergency care and emergency medical transport at the Participant’s sole cost and expense; and Participant further agrees to indemnify and hold Race Day organizers and Releasees harmless from and against any claims regarding the administration or direction of medical care including the coordination of emergency services including transport, or the failure to provide or administer such medical care or coordinate emergency services or transport.  Participant further authorizes any such medical professional on Course or called to the Course on Race Day to administer medical care, including emergency services, that they deem appropriate under the circumstances.   

            4) AND, HEREBY grants to Seattle Soccer, LLC, MLS, SUM, USL, MLS, RAVE Foundation, UNICO Properties, Fizz Events, City of Renton, Providence Swedish, and other Releasees the right to use Participant’s personality, including but not limited to any voice, image, likeness, photograph, audio or video recording that may be captured of Participant’s participation in the Events, in whole or in part, in any format or medium whether in existence or hereinafter created, including all derivatives thereof (collectively (“Media”), worldwide, royalty-free in perpetuity, for any purpose whatsoever, including for commercial, promotional or marketing purposes. All such captured Media, and all right, title and interest thereto shall become the sole property of Seattle Sounders FC. Participant further authorize Seattle Sounders FC to use your provided biographical data, including your name, city/town, and age in any form or medium (including newspaper, television, radio, billboards, Sounders FC website and social media networks), in perpetuity for any current or future Seattle Sounders FC, MLS, Releasee advertising or promotion (collectively, “Data”). Participant consents to be recorded, photographed, and videotaped related to the Events, and irrevocably and perpetually authorize Seattle Sounders FC, MLS, and any Releasee to copyright and make derivative works from, publish, reproduce, exhibit, transmit, broadcast, televise, license, digitize, display, use, and/or permit others to use (i) my name, image, likeness, and voice, and (ii) all photographs, recordings, videotapes, audiovisual materials, depictions, writings, statements, and quotations of or by myself obtained related to the recording of the Events in any manner, form, or format whatsoever now or hereinafter created, including, but not limited to, on the Internet and in social media, and for any lawful purpose without payment to Participant or consent beyond this Release, including, the advertising or promotion of the Seattle Sounders FC, MLS, and Releasee or the Events. Participant acknowledges and agrees that the right to participate in the Events is good and valuable consideration in exchange for this release and Participant will not be entitled to any future compensation for use of any Media or Data.  I acknowledge that I may rescind this right to use Participant Media in writing to 1901 Oakesdale Ave. SW, Suite 210, Renton, WA 98057.

RELEASEES make no warranty as to the suitability of the Course for the participation by any Participant on Race Day.  Participant also warrants to the Releases that Participant is physically able to perform the activities related to participating in the Events, to the best of Participant knowledge, Participant is in good physical condition and are not physically injured and/or currently under the care of a physician or under the influence of any drugs, including prescription medication, alcohol or marijuana or are aware of any other physical or mental condition or circumstance which would impair or restrict Participant’s ability to participate in the Events or that would affect the safety of others participating in the Events, and that Participant is not participating against medical advice. 

PARTICIPANT ACKNOWLEDGES AND AGREES THAT EXECUTION OF THIS RELEASE AND WAIVER IS A CONDITION PRECDENT TO BEING PERMITTED TO PARTICIPATE IN THE EVENTS.  PARTICIPANT ACKNOWLEDGES THAT THEY HAVE READ AND VOLUNTARILY SIGNS THIS RELEASE AND WAIVER AGREEMENT, and further agrees that no oral representations, statements, or inducement apart from the foregoing agreements have been made.

To the extent that any portion of this Agreement is deemed to be invalid under the law of the State of Washington, the remaining portions of the Agreement shall remain biding and available for use by the Releases and their counsel in any proceeding.
