1 ACKNOWLEDGMENT OF RISK
I understand and acknowledge that participation in the Joyful Motion Run for the Children 5K and 1 mile Fun Run (the “Event”) involves inherent risks, including but not limited to running or walking on paved and unpaved surfaces, uneven terrain, weather conditions, physical exertion, contact with other participants, park visitors, bicycles, animals, and the possibility of serious injury, illness, or death. I knowingly and voluntarily assume all risks, known and unknown, foreseeable and unforeseeable, associated with my participation in the Event.
2 RELEASE AND WAIVER OF LIABILITY
In consideration for being permitted to participate in the Event, I hereby release, waive, discharge, and covenant not to sue the Event Director, RunSignup.com, Pinellas County, A political Subdivision of the State of Florida Parks & Conservation Resources Department, Joyful Motion Inc., its directors, officers, employees, volunteers, agents, sponsors, and affiliates, as well as Pinellas County, Pinellas County Park and Conservation Services, and their respective officials, employees, and agents (collectively, the “Released Parties”), from any and all claims, demands, actions, causes of action, damages, losses, or liabilities of any kind arising out of or related to my participation in the Event. This release includes, but is not limited to, claims arising from negligence, premises conditions, equipment use, or the actions or inactions of the Released Parties, to the fullest extent permitted by Florida law.
3 MEDICAL CONSENT AND FITNESS TO PARTICIPATE
I certify that I am physically fit and have no medical condition that would prevent my safe participation in the Event. I understand that I am solely responsible for monitoring my physical condition before, during, and after the Event. I assume all risks associated with participating in this event including, but not limited to: Falls, contact with any other participants or personel, the effects of the weather, traffic, course conditions, and waive any and all claims which I might have based on any of those and other risks typically found in a running a road or trail race. I consent to receive medical treatment deemed necessary in the event of injury, accident, or illness during the Event and agree to be financially responsible for any such medical treatment, medical transport, medications, treatments, testing, and hospitalization.
4 PHOTO AND MEDIA RELEASE
I understand and acknowledge that Joyful Motion Inc. will have an official photographer and or videographer present at Joyful Motion Run for the Children 5k and 1 mile Fun Run. I grant permission for Joyful Motion and its partners to use photographs, video recordings, or other media taken during the Event that may include my image or likeness for promotional, educational, or fundraising purposes, without compensation.
5 INDEMNIFICATION
I agree to indemnify and hold harmless the Released Parties from any claims, damages, costs, or expenses (including attorneys’ fees) arising from my participation in the Event or my failure to comply with Event rules and instructions.
6 GOVERNING LAW AND SEVERABILITY
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
THIS RELEASE IS INTENDED TO BE AS BROAD AND INCLUSIVE AS PERMITTED BY THE LAWS OF THE STATE OF FLORIDA, INCLUDING CLAIMS ARISING FROM NEGLIGENCE. I ACKNOWLEDGE THAT I AM WAIVING SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
